APPEAL - According to the Code of Court Procedure in Civil Litigations in 1929 –

Abstract

The Code of Court Procedure in Civil Litigations brought in 1929 was a legal text which regulated the rules for acting in Civil Proceedings. This comprehensive code, which was valid on the territory of the Kingdom of Yugoslavia, offered a specific system of legal remedies among which was the appeal (complaint).

Since the technical rules concerning the volume of this paper did not allow a full analysis of this legal remedy, the author in the paper first commented on the system of legal remedies according to the Code, then explained the legal nature of this legal remedy and its characteristics, with a special attention devoted to the issues regarding the elements of the formal contents of the appeal as a legal remedy. Finally, additional stress was put on analyzing the appeal reasons and appeal proposal, as the most important elements of the formal contents of the legal remedy. At the end of the paper the author presented the appeal procedure before first instance litigation court, as well as the preliminary procedure before the court that had decided on it.
