PROTECTION OF THE RIGHTS OF THE DEFENDANT IN CRIMINAL PROCEEDINGS

The defendant, as a party to criminal proceedings, has a certain fund of rights and duties, which collectively determine his procedural position. As a rights holder, he is defined as a procedural subject, while as a duty holder, he is treated as an object in criminal proceedings. In the paper, the author pays attention to certain rights of the defendant, which are also proclaimed by international documents and are also given in national normative frameworks. Mechanisms for the protection of the rights of the defendant are established by the possibility of filing a constitutional complaint and, on the other hand, a petition to the European Court of Human Rights. The normative and analysis of individual judgments provide proposals aimed at the work of police and judicial authorities, in the direction of effective implementation of certain legal provisions.
