INTERNATIONAL STANDARDS ON DOMESTIC VIOLENCE AND THEIR APPLICATION IN THE REPUBLIC OF SERBIA: ISTANBUL CONVENTION

Abstract

Violence against women is a widespread social problem rooted in the unequal distribution of resources and power between men and women, and institutionalized through laws, policies and social norms that grant preferential rights to men. Violence against women and girls is not just a story about unhealthy individuals, families or relationships, but about unhealthy social norms and often the damaging consequences of poverty. Part of the solution to such violence, therefore, lies in addressing the drivers of gender inequality and other forms of discrimination. Relevant factors include legislative, economic, and cultural structures, and legal, educational, workplace, family, religious, sports, media and other institutions that might fuel inequalities in women and girls access to education and social and political participation.

The general prevalence of domestic violence makes it a global phenomenon; therefore, it is a phenomenon that requires a comprehensive approach not only at the local, but also at the national and international level. In the last few decades, domestic violence has become a subject of increasing debate in the international community. Even the United Nations, the world's largest and most influential organization, is increasingly focusing on this issue, considering it and establishing obligations and recommendations that member states should respect. That is why this paper deals with the analysis of international standards on domestic violence with special emphasis on the Istanbul Convention, which, as the first regional document in this area, influenced the redefining of the national legislative framework in Serbia and contributed to the adoption of the first law. the state's response to the problem of violence against women in the family and partnerships.
