SOCIAL CONFLICT OF INTERESTS IN THE DIGITAL ENVIRONMENT AND CRIMINAL LAW MECHANISMS FOR IMPLEMENTING THE CHILD’S RIGHT TO PROTECTION FROM DESTRUCTIVE INFORMATION INFLUENCE

The article examines the complex nature of social conflicts of interest emerging within the modern digital environment, specifically focusing on the tension between freedom of information and the necessity of safeguarding minors. The author analyzes the evolving landscape of digital threats, including cyberbullying, incitement to suicide, and the involvement of minors in illegal activities through social networks. Central to the study is the evaluation of current criminal law mechanisms designed to implement the child’s fundamental right to protection from destructive information influence. The research highlights gaps in existing legislation and explores the challenges of imposing criminal liability for illegal activities in the information space. By examining national legal frameworks, the paper proposes enhancements to legal instruments to better address the psychological and physical risks posed to children. The study concludes that a balanced approach, combining rigorous criminal law enforcement with proactive digital literacy of children and their parents, is essential to resolve the identified conflict of interests and ensure a safe information environment for the younger generation.
