PRINCIPLES OF THE AGREEMENT ON TRADE-RELATED ASPECTS OF INTELLECTUAL PROPERTY RIGHTS IN INTERACTION WITH HUMAN RIGHTS

After 30 dynamic years since the entry into force of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), the scope and impact of this agreement are still hotly debated in theory and practice. Originally, the TRIPS Agreement emerged from decades of efforts through rounds of multilateral negotiations to overcome numerous challenges in the global protection and enforcement of intellectual property rights between states, culminating in the creation of the World Trade Organization in 1995.
The paper is dedicated to the analysis and presentation of the basic principles underlying the provisions of the Agreement on Trade-Related Aspects of Intellectual Property Rights, which are part of the protection of intellectual property rights holders at the international level, but also part of the numerous challenges in the application of the provisions of this agreement in relation to the wider family of human rights.
