IS JUSTICE A PRIVILEGE OF (ONLY) DEVELOPED SOCIETIES? PUBLIC SERVICES AS A FACTOR OF JUSTICE ACCESSIBILITY AND SOCIAL DEVELOPMENT

Правда, прокламована као универзално право, и даље остаје недостижна као реалност за многе људе широм света. Њен квалитет и практични домети битно су одређени географијом посматраног простора односно начином јавног управљања и квалитетом јавних услуга. Структурне неједнакости у погледу доступности правде нису случајна и непредвидива појава, већ су укорењене у политичким одлукама и институционалним аранжманима. Основна тврдња у овом раду је то да је правда нераскидиво повезана са инфраструктурним и административним капацитетима државе, те да владе морају бити схваћене као централни актери у омогућавању или онемогућавању адекватног приступа правном систему и правди уопште. Истицањем улоге јавних услуга (правна помоћ, системи за издавање личних докумената, саобраћајна инфраструктура, дигитални приступ и образовање), у овој анализи се заступа идеја правде као облика друштвене инвестиције. У чланку се даје приказ теоријске основе анализиране проблематике, затим се дијагностикују основне структурне препреке правди и анализирају индикативни и поучни примери из међународне праксе. На крају су дате практичне препоруке за креирање јавних политика у правцу праведнијег и инклузивнијег друштва.
